1. AGREEMENT TO TERMS

By accessing or using GrowthForge AZ services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.

2. DESCRIPTION OF SERVICES

GrowthForge AZ provides automated communication services for Arizona landscaping businesses, including missed call text-back, appointment reminders, review requests, lead follow-up, and invoicing automation. Services are provided in both English and Spanish.

3. ELIGIBILITY

Our services are available only to Arizona-based landscaping businesses that are legally registered, have at least $10,000 in monthly revenue, and have the legal authority to enter into these terms. Business owners must be at least 18 years old.

4. USER RESPONSIBILITIES

You are responsible for:

  • Providing accurate business information during signup
  • Maintaining an active business phone number and internet connection
  • Complying with all applicable laws and regulations regarding customer communications
  • Reviewing and approving all automated message templates before activation
  • Responding to customers who reply to automated messages

5. PAYMENT TERMS

Service pricing is $97/month (Starter), $197/month (Growth), or $397/month (Pro) as selected during signup. Payment is due at the beginning of each billing cycle. We accept credit card and ACH transfers. A 2-week free trial is available for the Growth plan.

6. FREE TRIAL AND REFUND POLICY

New customers on the Growth plan receive a 2-week free trial with no credit card required. If you are unsatisfied within the first 30 days of paid service, we will provide a full refund. After 30 days, all payments are non-refundable. You may cancel at any time without penalty.

7. PRIVACY AND DATA

We collect and store customer phone numbers and basic contact information only as necessary to provide our services. We do not sell customer data to third parties. All customer communications are securely stored and may be reviewed for quality assurance. By using our services, you consent to automated communication on behalf of your business.

8. SERVICE GUIDELINES

We reserve the right to refuse or terminate service for businesses that:

  • Use our services for spam or unwanted communications
  • Violate federal or state regulations regarding business communications
  • Engage in fraudulent or deceptive practices
  • Request messaging that promotes discrimination or illegal activities
  • Are located outside Arizona (service area limitation)

9. LIMITATION OF LIABILITY

GrowthForge AZ is not responsible for:

  • Lost business opportunities due to system downtime
  • Customer complaints about automated communications
  • Compliance with industry-specific regulations beyond basic communication laws
  • Technical issues with your phone carrier or internet service
  • Actions taken by customers in response to automated messages

10. TERMINATION

Either party may terminate service at any time with written notice. Upon termination, automated services will be disabled within 24 hours, and you will retain access to reporting data for 30 days. No refund will be provided for partial months.

11. CHANGES TO TERMS

We may update these Terms of Service at any time with 30 days notice via email. Continued use of services after changes constitutes acceptance of new terms.

12. GOVERNING LAW

These terms are governed by the laws of the State of Arizona. Any disputes will be resolved in the courts of Maricopa County, Arizona.
